This case follows Omeki, a global SME with a 100% telework workforce, through their negotiations with a member of the IT team, to terminate their employment while navigating Japanese labor laws. Japan has some of the strictest labor laws in the world that make it incredibly difficult to terminate an employee. In this case, the employee, copied corporate confidential HR and accounting data to their personal cloud drive. Despite what would be an easy dismissal in many other countries, Omeki was unable to promptly dismiss this employee. Having to rely on the traditional method of offering severance to the employee, regardless of what the employee did, to get them to agree to resign in such way that the employee cannot then sue the company for power harassment. Covering such topics as decision tree analysis, applying a negotiation framework, and risk analysis with insight to the Japanese labor market and culture, this case is designed for first-year MBA students with no prior knowledge of negotiation or risk analysis. Included is also a negotiation simulation for two teams of three students each to engage in practical implementation of negotiation strategies for a complex two-party distributive negotiation. With students roleplaying Omeki and the IT staff member as they navigate a time-based negotiation where one party is incentivized to make a deal in as little time possible and the other to stall for as long as possible to maximize their respective payouts. The simulation is geared towards students with prior negotiation simulation experience as there is multiple issues that need to be resolved with timing affected payouts.
